TWO GANG MEMBERS TO BE ARRAIGNED FOR THE SHOOTING MURDER OF UNARMED MAN WHILE SPRAYING GRAFITTI IN UNINCORPORATED ANAHEIM

SANTA ANA, Calif. – Two criminal street gang members have been charged and are scheduled to be arraigned tomorrow for the shooting murder of an unarmed man while they were spraying graffiti in unincorporated Anaheim. David Steven Ortega, 33, Chino, is charged with one felony count of special circumstances murder and one felony count of attempted murder, with sentencing enhancement allegations for criminal street gang activity, personal discharge of a firearm, and vicarious discharge of a firearm by a gang member. If convicted, Ortega faces a minimum sentence of life in state prison without the possibility of parole.

Co-defendant Edgar Ramirez,21, Anaheim, is charged with one felony count of murder and one felony count of attempted murder, with sentencing enhancement allegations for criminal street gang activity and vicarious discharge of a firearm by a gang member. If convicted, Ramirez faces a maximum sentence of 25 years to life in state prison. The defendants are scheduled to be arraigned tomorrow, April 20, 2016, in Department CJ-1, Central Jail, Santa Ana. The time is to be determined.

On the night of July 19, 2015, Ortega and Ramirez are accused of tagging gang graffiti in the neighborhood on Lullaby Lane in unincorporated Anaheim. John Doe and 51-year-old David Douglas interrupted Ortega and Ramirez, and John Doe briefly followed the defendants on foot. Douglas subsequently drove his SUV to the end of the street and picked up John Doe.

Shortly thereafter, Ortega is accused of shooting Douglas and John Doe with an additional accomplice after John Doe got in the vehicle. The defendants are accused of leaving the scene.

Douglas and John Doe were transported to the hospital. Douglas died as a result of multiple gunshot wounds, including one to the neck area. John Doe survived multiple gunshot wounds, including one to the back of his head.

The Orange County Sheriff’s Department’s (OCSD) investigation in this case is ongoing. Ortega was arrested by OCSD yesterday, April 18, 2016, in Los Angeles. Ramirez is currently in custody serving a sentence for a Feb. 25, 2016 misdemeanor conviction for carrying a dirk or dagger.

Deputy District Attorney Chris Alex of the Gang Unit is prosecuting this case.
