71-YEAR-OLD MAN CHARGED WITH SEXUALLY ASSAULTING TWO 10 -YEAR-OLD GIRLS, INCLUDING FORCIBLE RAPE OF ONE AND LEWD ACTS AGAINST THE OTHER
WESTMINSTER – A 71-year-old man has been arrested and charged with forcibly raping a 10-year-old girl and committing lewd acts against another and possessing pornographic photos of her. Donald Roy Shipley, 71, Fountain Valley, is charged with one felony count each of forcible lewd acts on a child under 14, lewd acts on a child under 14, aggravated sexual assault of a child, one misdemeanor count of possession and control of child pornography, and a sentencing enhancement allegation for committing a sexual offense against more than one victim. If convicted, the defendant faces a maximum sentence of 40 years and eight months to life in state prison. Shipley was arrested today, July 18, 2012, by the Fountain Valley Police Department (FVPD) and is being held on $1 million bail. He is expected to be arraigned July 19, 2012, at the West Justice Center in Westminster. The time is to be determined.
At the time of the crimes, the defendant is accused of living in a Fountain Valley home with an adult female and a young female relative.
Sometime between January and December 2008, 10-year-old Jane Doe #2 was in Shipley’s home visiting the defendant’s young female relative. Shipley is accused of taking the victim into his bedroom and forcibly raping her. The case was not immediately reported.
Sometime between January and December 2009, Shipley is accused of committing lewd acts against 10-year-old Jane Doe #1, who lived in his neighborhood. Shipley is accused of possessing pornographic photographs of her in various states of undress. The law describing lewd acts on a child includes but is not limited to undressing, touching, kissing, or engaging in any sexual act by the defendant or at the instruction of the defendant with the intent of arousing, appealing to, and gratifying the lust, passions, and sexual desires of the defendant and/or the child.
In May 2011, FVPD began investigating Shipley for possession of child pornography. The defendant is accused of being in possession of over a dozen pornographic images of young girls between the approximate ages of 10 and 13 years old. Many of the images appeared to be photographs taken in the defendant’s home.
In the course of the investigation, detectives learned the identity of Jane Doe #1. Jane Doe #2, unaware of the ongoing investigation, reported the rape against her while the other investigation was ongoing.
