FORMER OCSD DEPUTY FACES TRIAL FOR SEXUALLY ASSAULTING TEENAGE GIRL WHILE ON DUTY

 

SANTA ANA – A former Orange County Sheriff’s Department (OCSD) deputy faces trial today for sexually assaulting a teenage girl while on duty. Scott Allan Cole, 43, Hesperia, is charged with one felony count of sexual penetration by a foreign object of a minor and faces a maximum sentence of three years in state prison and possible lifetime sex offender registration if convicted. Opening statements are expected to begin today, Sept. 19, 2012, at 10:30 a.m. in Department C-37, Central Justice Center, Santa Ana.

 

At the time of the crime, Cole was an OCSD deputy.

 

On June 23, 2010, Cole is accused of being on duty and responding to a home located in an unincorporated area of Tustin related to a report of jewelry theft and a 17-year-old, Jane Doe, attempting to run away. Cole is accused of entering the home and talking to Jane Doe, her mother, and her sister in the living room.

 

The defendant is accused of then entering Jane Doe’s bedroom and telling the victim to take off some of her clothes. He is accused of temporarily leaving the bedroom and talking to the mother and sister in the living room again before going back to Jane Doe’s room and closing the door. Cole is accused of digitally penetrating Jane Doe. Once Cole left the residence, the victim immediately disclosed the sexual assault to her mother.

 

The sexual assault was reported to the Tustin Police Department, who contacted OCSD for investigation because the residence was in their jurisdiction. The Orange County District Attorney’s Office assisted in the subsequent investigation.

 

If convicted, Cole’s lifetime sex offender registration will bar him from entering County recreational areas and City parks which have passed the Sex Offender Ordinance.
