MAN CONVICTED OF FORCIBLY SODOMIZING 8-YEAR-OLD FEMALE RELATIVE IN ELEVATOR AND ALLEY

 

SANTA ANA – A 25-year-old man was sentenced today to 38 years to life in state prison for forcibly sodomizing his 8-year-old female relative in an elevator and alley. Luis Alberto Otero, Santa Ana, was convicted by a jury Jan. 19, 2011, of two felony counts of aggravated sexual assault of a child and two felony counts of lewd acts on a child under 14.

 

Between April 2003 and May 2007, Otero sexually assaulted his female relative including digital penetration on multiple occasions beginning when she was 6 years old. On one occasion, the defendant sodomized the victim in an elevator.

 

When Jane Doe was 8 years old, Otero approached her while she was playing outside of her home with a friend. He lured her away from the yard by offering to take the victim to 7-Eleven for a Slurpee. After the victim walked away with Otero, the defendant dragged Jane Doe to the back of an alley, where he forcibly sodomized her twice as she struggled to escape.

 

The victim later disclosed the sexual assault to a school social worker.

 

During the jury trial, evidence was presentenced that Otero confessed to police that he had sodomized the victim on one occasion. He claimed that he sodomized her because it was her idea.

 

Senior Deputy District Attorney Heather Brown of the Sexual Assault Unit prosecuted this case.
