WHO: Inmate Scott Anthony Smith, 45
WHAT: Was denied resentencing yesterday, July 11, 2013, at a Proposition 36 resentencing hearing by the Honorable W. Michael Hayes. Smith is being held at California Substance Abuse Treatment Facility and State Prison, Corcoran.
Assistant District Attorney Ted Burnett opposed Smith’s release on behalf of the Orange County District Attorney’s Office (OCDA).
At yesterday’s hearing, the Court reviewed Smith’s criminal background both in and out of prison and determined that the inmate poses an unreasonable risk to public safety based on his criminal record and behavior while incarcerated.
Criminal Background for Inmate Smith Considered by Court
On May 1, 1987, Smith was convicted of one misdemeanor count of public intoxication and was sentenced to three days in jail.
On April 24, 1987, Smith was convicted of one misdemeanor count of possession of stolen property and was sentenced to 30 days in jail. In October 1987, Smith violated his probation and was sentenced to an additional 10 days in jail.
On Jan. 25, 1989, Smith was convicted of one misdemeanor count of being under the influence of cocaine and was sentenced to 90 days in jail.
On Feb. 26, 1990, Smith was convicted of one misdemeanor count of being in possession of stolen property and was sentenced to 60 days in jail.
On Nov. 3, 1992, Smith was convicted of one misdemeanor count of burglary and was sentenced to 90 days in jail.
On May 6, 1993, Smith pleaded guilty to five felony counts of residential burglary. Smith was sentenced to three years and four months in state prison (Five Strike Offenses).
