WHO: Inmate Michael David Benedict, 58
WHAT: Was found ineligible for resentencing Friday, June 21, 2013, at a Proposition 36 resentencing hearing by the Honorable Gary S. Paer. Benedict is being held at California Substance Abuse Treatment Facility and State Prison, Corcoran.
Deputy District Attorney Kelly Roosevelt opposed Benedict’s release on behalf of the Orange County District Attorney’s Office (OCDA).
At Friday’s hearing, the Court reviewed Benedict’s criminal background and determined that the inmate is ineligible for resentencing because he was armed with a firearm during his commitment offense.
Criminal Background for Inmate Michael David Benedict
On July 19, 1977, Benedict was convicted of one misdemeanor count of fighting in public and sentenced to two years of probation.
On Jan. 17, 1978, Benedict was convicted of one misdemeanor count of second degree burglary and sentenced to one year of probation and eight days in jail.
On July 25, 1978, Benedict was convicted of one misdemeanor count of battery and sentenced to two years of probation.
On Aug. 16, 1982, Benedict was convicted of one misdemeanor count of forgery and one misdemeanor count of receiving stolen property. He was sentenced to two years of probation and 60 days in jail.
On Nov. 21, 1983, Benedict was convicted of one misdemeanor count of petty theft and sentenced to two years of probation and one week in jail.
On June 29, 1987, Benedict was convicted of one misdemeanor count of petty theft and sentenced to three years of probation.
