NINTH-STRIKER SEX OFFENDER SENTENCED TO 25 YEARS TO LIFE FOR BEING IN POSSESSION OF HUNDREDS OF THOUSANDS OF PORNOGRAPHIC IMAGES AND VIDEOS OF CHILDREN
SANTA ANA – A sex offender with nine prior strike convictions was sentenced today to 25 years to life in state prison for being in possession of hundreds of thousands of pornographic pictures and videos of children, as well as books and Internet print-outs on torture, rape and murder of children. Vaughn Robert Biby, 47, Fullerton, pleaded guilty today just prior to opening statements in his jury trial to one felony count each of possession and control of child pornography, and sexual exploitation of a child. The sentencing enhancements for nine prior strike convictions for lewd and lascivious acts on minors in Orange and Los Angeles Counties in 1995 and a prison prior for child molest were found true.
Between November 2009 and March 2010, Biby was in possession of hundreds of thousands of photographic images and computer-printed images of child pornography, which were indexed and saved in his Fullerton home. He had pornographic photographs depicting infants and young children bathing, swimming in pools, and being potty trained. The defendant had in his possession books about child rape, torture and murder, printed pedophile stories from the Internet, and home videos, tapes and DVDs depicting naked children.
Biby was in possession of Chuck E. Cheese tokens to lure children and several different library cards. He had recently worked as a truck driver for a portable toilets company and delivered portable toilets to parks and venues where children congregate.
On March 25, 2010, the Fullerton Police Department and the Department of Probation conducted Sex Offender Compliance Check searches on selected high-risk sex offenders, including Biby’s residence, and discovered the child pornography.
Deputy District Attorney Nicole Nicholson of the Sexual Assault Unit prosecuted this case.
