TEEN CHARGED AS ADULT FOR SEXUALLY ASSAULTING 9-YEAR-OLD BOY
USING TOY LIGHT SABER

 

SANTA ANA – A Riverside teen was charged today as an adult for sexually assaulting a 9-year-old boy by anally penetrating him with a hand and a toy light saber while other children watched. Javier Enrique Perez, 16, Riverside, was charged this afternoon with felonies for sexual penetration by foreign object by force, aggravated sexual assault of a child, and rape by foreign object acting in concert. He is being held on $1 million bail and faces a maximum sentence of 15 years to life in prison if convicted. Perez is scheduled for continued arraignment Aug. 8, 2008, at 9:00 a.m. in Department C-55, Central Justice Center, Santa Ana.

 

At approximately 5:00 p.m. on July 16, 2008, 9-year-old John Doe was dropped off at a Santa Ana home by his mother, who was leaving him to be watched while she went to work. Perez, who is associated with the homeowner, was at the house along with several other children ranging in age from 8 to 19 years old. While two boys watched, Perez is accused of sexually assaulting John Doe in the kitchen with the help of a third child, age 8, who participated at the instruction of Perez. Perez is accused of pushing John Doe over the kitchen table, holding him down, and forcibly anally penetrating him with a hand and a toy light saber. After assaulting the victim, Perez is accused of instructing the other boys not to tell anyone what he had done.

 

The victim’s mother arrived at approximately 9:00 p.m. to pick up John Doe, and the victim told his mother about the assault. John Doe’s mother took him to the hospital, and ultimately the Orange County Social Services Agency and Santa Ana Police Department were contacted.

 

Deputy District Attorney Robert Mestman of the Sexual Assault Unit is prosecuting this case.
