UNCLE SENTENCED TO 61 YEARS TO LIFE FOR MOLESTING THREE NIECES AND ONE NEPHEW
SANTA ANA – A Costa Mesa man was sentenced today to 61 years to life in prison for sexually assaulting his three nieces and one nephew while the children were living in his home. Gilberto Garibay, 45, was convicted on August 14, 2007 of 28 felony counts of lewd acts on a child under 14 and one misdemeanor count of child annoyance.
Between October 1, 2001 and March 1, 2004, Garibay molested his three nieces and one nephew while they were living in his home with their mother after their father passed away in an industrial accident. Garibay sexually assaulted the three girls on numerous occasions while they were in the bathroom after they had bathed. The defendant digitally penetrated the female victims and masturbated the male victim. None of the four victims were aware of the sexual assault of their siblings.
The children were removed from their uncle’s home in an unrelated matter and placed in foster care. The victims disclosed that they had been sexually assaulted to their foster mother, who contacted the police.
Deputy District Attorney Heather Brown of the Sexual Assault Unit prosecuted this case.
